TOWN OF SWANTON

NOTICE OF INTENT TO CONVEY REAL ESTATE

The Selectboard of the Town of Swanton, pursuant to 24 VSA ยง 1061, hereby gives notice of the intent to convey real estate presently owned by the Town of Swanton. The property in question consists of 5 acres of landlocked land with a tax map location of 261 First Street in the Town of Swanton. This real estate was formerly owned by the now defunct Northwest Interfaith Council and was acquired by the Town of Swanton on May 16, 2022 and of record in Book 401, Pages 200-201 of the Land Records of the Town of Swanton.

This real estate is bounded by lands of the Missisquoi Valley School District and lands of Mr. Brian Rowell. The MVSD has utilized approximately 1.29 acres of this land for school purposes for many years and recently constructed a road way on the property to access Missisquoi Valley Union High School. Therefore, via Boundary Line Adjustment as approved by the Design Review Board of the Town of Swanton on September 26, 2024, the Town of Swanton has proposed to convey the said 1.29 acres of the parcel to Missisquoi Valley School District.

The Selectboard has proposed to convey the remaining 3.61 acres of the parcel to Mr. Brian Rowell via Quit Claim Deed. This conveyance is in exchange for a .75-acre parcel of land that Mr. Rowell will convey via Boundary Line Adjustment as approved by the Design Review Board of the Town of Swanton on September 26, 2024 that is adjacent to the property owned by the Town of Swanton at 221 First Street in the Town of Swanton that is occupied by the Swanton Town Highway Garage complex.

If a petition signed by five percent of the legal voters of the municipality objecting to the proposed conveyance is presented to the municipal clerk within 30 days of the date of posting and publication of the notice required by state statute, the legislative body shall cause the question of whether the municipality shall convey the real estate to be considered at a special or annual meeting called for that purpose. After the meeting, the real estate may be conveyed unless a majority of the voters of the municipality present and voting vote to disapprove of the conveyance.
